- The South-DMC forwarded (online) the proposal for consideration by the Commission.
- The Commission approved the building plans proposal at the formal stage at its meeting held on January 17, 2018 and subsequently accepted the NOC for part completion plans proposal for (Tower-I and Tower-II) at its meeting held on September 19, 2024, specific observations were given.
- The Commission did not approve the building plans proposal for (Tower-III comprising of basement + G+ 8 floors, with basement already constructed with Tower-I & II) at its meeting held on September 4, 2025; specific observations were given.
- The building plans proposal for (Tower-III comprising of basement + G + 8 floors, with the basement already constructed with Tower-I &II) received (online) at the formal stage was scrutinised along with replies submitted in response to the previous observations of the Commission communicated vide DUAC letter no. OL-28082458037 dated 11-09-2025. Based on the replies submitted and the submission made, the following observations are to be complied with:
a) The Commission observed that while replying to one of its previous observations, the architect has indicated the reason of resubmission that:
“…..same proposal of tower-iii was with complete master plan at the time of formal appraval. tower-i and tower-ii received cc also. due to expiry of validity period of sanction drawings, same proposal of tower-iii again submitted for formal approval for consideration of duac committee….”
The Commission noted the reason for resubmission indicated by the architect.
b) All parking provisions shall adhere to all the applicable norms/guidelines/regulations, etc.
c) The installation of clear-story solar panels on a well-designed structural frame, integrated with the building design, is suggested to ensure the effective utilisation of the space beneath, subject to feasibility as per building bye-laws. This placement also facilitates easy maintenance, reduces heat load through increased shading, and improves aesthetics. The sustainability features shall be as per Point 7 of the CPAA (Criterion for Project Assessment and Approval), available on the DUAC website at www.duac.org.in.
d) The Work of public art of suitable scale, size and material, imparting character and identity to the complex shall ensure to be installed in terms of point nos. 14 of the CPAA (Criterion for Project Assessment and Approval) and Memorandum dated October 07, 2025 available on the DUAC website at www.duac.org.in. Any deviations in the artwork from the approved design must be submitted to the Commission for prior approval before the commencement of construction, to ensure compliance and facilitate final approval upon project completion.

- The proposal was forwarded by the South DMC (online) for consideration by the Commission.
- The Commission did not approve the Layout and the Building plan proposal at its meeting held on October 20, 2000. However, the building plan proposal (2B+G+5 Floors) was constructed on the site, by the proponent, on the basis of approvals given by the MCD. Later, the Commission accepted the proposal for NOC for Completion at its meeting held on August 12, 2015, specific observations were given.
- The Commission did not approve the proposal for additions and alterations (addition of three (03) floors over the existing (2B+G+5 floors) at its meeting held on December 22, 2022.
- Now the building plan proposal for additions and alterations (addition of three (03) floors (6th, 7th, & 8th floor) over the existing (2B+G+5 floors) received (online) at the formal stage was scrutinised along with the previous observations of the Commission communicated vide DUAC observation letter no: OL-17122255080 dated 28.12.2022. Based on the submission made and previous observations given, the following observations are to be complied with:
a) The Commission observed while considering the case for additions/alteration it did not consider and cover the existing built construction at the site. This concerns the proposal for additions/alterations only.
b) It has been observed that the submission has been resubmitted without satisfactorily addressing previous observations outlined in DUAC letter no: OL-OL-17122255080 dated 28.12.2022 which is not appreciated.
c) It was previously observed that:
“(a) …The Commission observed that the proposal is for the addition of three more floors (6th, 7th and 8th floor) above on an existing built construction (2B+G+5 Floors) but the cropped and fudged photographs of the existing site development have been given which does not elucidate the site development sufficiently. Uncut clear photographs (including basements, area accommodating Gen Set, DG exhaust pipes, Chiller plant etc.) must be provided for the judicious consideration of the proposal (formal stage) better….
f) The sections need to be detailed (longitudinal and cross-section across the site as well) clearly showing the architectural elements, sun shading mechanisms, plumbing details etc. The Plans and elevations for all drawings across the site shall be co-related and submitted. The elevation features in the buildings are not reflected in the plans/sections….”
These issues still remain noncompliant in the current submission, thereby rendering the submission unsuitable for proper review.
d) The site plan indicates a large rear setback area for double-stack parking. However, no site photographs of this area have been provided, thereby unable to assess the actual site conditions or identify existing features. Since the submission is at the formal stage, involving an addition or modification within an existing complex, complete, unedited photographs of all sides are necessary for a clear understanding of the current site conditions.
e) The site plan indicates a 9.0 m wide front setback; however, this is not clearly reflected in the submitted site photographs. Clear, uncut site photographs of the front setback area are required to clearly illustrate these details.
f) The proposed site plan and 3D views indicate double-stack parking located at the rear side of the site. However, the double-stack parking structure appears to be proposed too close to the building, potentially obstructing the view of the lower floors and hindering access for maintenance activities. It must be ensured that the parking design does not interfere with the building’s lighting, ventilation, or accessibility for maintenance.
g) The parking statement indicates the provision of parking spaces in the basement; however, this has not been clearly illustrated in the proposed drawings. Additionally, photographs of the existing basement have not been submitted, rendering the submission incomplete.
h) The location the DG set and associated services have been shown in the 3D views but other necessary details etc., are not indicated in the site plan. Details of the DG set, DG exhaust pipes etc., including its screening mechanisms to be provided in the revised submission.
i) To provide a broader site context, the 3D views shall be superimposed with the site’s surroundings, reflecting the existing environment and showcasing neighbouring building typologies, street patterns, access routes, and overall built character.
j) Since the building involves an addition of three more floors above an existing building, a lot of live and dead load is also being added to it, the concerned local authority must ensure structural safety.
k) All parking provisions shall adhere to all the applicable norms/guidelines/regulations, etc.
l) The installation of clear-story solar panels on a well-designed structural frame, integrated with the building design, is suggested to ensure the effective utilisation of the space beneath, subject to feasibility as per building bye-laws. - The building plans proposal for addition and alterations (proposed modifications include the construction of an additional staircase, the provision of new room partitions, installation of new lifts, and the addition of toilets, among other changes) received (online) at the formal stage was scrutinised. Based on the submission made, the following observations are to be complied with:
a) The Commission noted that no previous record of approvals (formal or completion) obtained from the Commission has been found in its available records. According to the project report, the building has already received a Completion Certificate from the relevant local authority under letter number F13(52)04 Building, dated 23 Dec 2005.
b) The Commission observed that while considering the case for additions/alterations, it did not consider or cover the existing built construction at the site. This concerns the proposal for additions/alterations (proposed modifications include the construction of an additional staircase, the provision of new room partitions, installation of new lifts, and the addition of toilets, among other changes) only.

- The building plans proposal for addition/alteration (addition of office area from 2nd to 8th floor) was approved by the Commission at its meeting held on March 21, 2024 with specific observations were made.
- The revised building plans proposal for additions and alterations (At ground floor – small toilet blocks, at first floor – a terrace is converted to usable space) received (online) was scrutinized. Based on the submission made, the following observations are to be complied with:
a) The Commission observed that while submitting the proposal for the review, the architect has indicated the following:
“…..The project had already received approval from the DUAC for additional construction and alterations to the existing structure under letter number 22(92)/2024-DUAC/OL-18032422092 dated March 28, 2024. However, before granting approval, the DDA asked us to make certain additions to the plans, which are indicated and highlighted in the relevant plans and images. The DDA is seeking reapproval for these additional amendments from the Commission. Those changes are outlined below:
• At ground floor – small toilet blocks have been added.
• At first floor – a terrace is converted to usable space….”
b) The proposed toilet size appears to be very small in size. Considering the space constraints, it is suggested to remove the washbasin counter and instead provide pedestal washbasins enhancing available space for circulation. Alternatively, one WC can be removed, and the remaining space can be divided between the two WCs to ensure greater space availability based on the requirements of the applicable building byelaws.
c) All parking provisions shall adhere to all the applicable norms/guidelines/regulations, etc.

- The Commission approved the building plan proposal for additions/alterations in the Oncology Block (addition of first to eleventh floors over the existing ground floor & two basements) at its meeting held on November 11, 2022, specific observations were given. The Commission accepted the completion plans (part-for addition/alterations approved in 2022) at its meeting held on April 17, 2025; specific observations were made.
- The proposal for NOC for complete completion received (online) was scrutinised. Based on the submission, including documentation, drawings, and photographs, the following observations are to be complied with:
a) The Commission observed that it has accepted the part NOC for completion (addition of Oncology Block: 2 Basements + Ground floor) at its meeting held on April 18, 2018, and accepted the part NOC for completion (part-for addition/alterations approved in 2022) at its meeting held on April 17, 2025.
b) The Commission noted the request from the concerned architect vide their email dated 12.11.2025 requesting that:
“…….Please find attached the request letter for Consolidated Approval of the Oncology Block at Max Super Speciality Hospital, Shalimar Bagh, for your kind perusal. We confirm that there have been no changes, modifications, or deviations in the approved drawings or the construction executed at site. The layout, elevations, and dimensions remain exactly as approved by the Commission. This submission is made to seek consolidated approval covering Basement-3, Basement-2, Basement-1, Ground, and 11 Upper Floors, as per the enclosed drawings….”
- Based on the fact that enumerated above including the email request received from the architect, the complete NOC for completion for the Oncology Block is found to be accepted.

- The Commission approved the building plans proposal in respect of the (Academic Building for NUEPA) at its meeting held on February 9, 2018, specific observations were given.
- The proposal for NOC for completion received (online) at the completion stage was scrutinised and a detailed discussion was held with the architect (online) on Cisco Webex meetings, during which clarifications were provided to the Commission’s queries. Based on the submission made, including drawings, documentations, and photographs, etc, the discussion held, the following observations are to be complied with:
a) The Commission noted that the artwork in the site photographs does not align with the previously approved (formal) submission, with differences in both design and size. Any changes to the approved artwork must be submitted to the Commission for approval before construction begins, ensuring compliance and smooth final approval after project completion.
b) The Commission observed that as per submitted photographs the Indian map on the globe is distorted. It should be ensured that the artwork, especially regarding the depiction of ‘INDIA’, is accurately and proportionally reproduced to preserve its sanctity, and is executed as per the most current approval by DUAC.
- Overall, the proposal received at the completion stage has discrepancies and does not match the previously approved submission at the formal stage. The architect is advised to adhere to all the above observations and provide a point-by-point response incorporating the details.

- The ‘North Block and South Block’ located at Lutyens’ Bungalow Zone (LBZ), Central Vista, are listed as Grade-I heritage buildings at Serial No. 7 in the Gazette Notification No. F. No. 4/2/2009/UD/I 6565 dated 01.10.2009, issued by the Department of Urban Development, Government of NCT of Delhi.
- The building plans proposal received (online)was scrutinised, and a detailed discussion was held with the architect on Cisco WebEx meetings, who provided clarifications to the queries of the Commission.Based on the discussion held online, and the submission made, the following observations are to be complied with:

The current design appears basic with minimal architectural elements that enhance urban and environmental aesthetics. Additionally, it is advised to include voids at certain levels so these spaces can be effectively used as recreational areas for children, the elderly, and others during harsh weather conditions, while also serving as refuge areas.
b) Also, it is suggested to connect the towers at the terrace level so that the connected areas can be used for recreational purposes while ensuring the safety of the users.
